The Terms and Conditions outlined below apply to UK purchases made from the Whistles website: www.whistles.com. Your acceptance of the Terms and Conditions is given when you make a purchase from Whistles. It is important to read these Terms and Conditions carefully before buying goods from our website.

Whistles reserves the right to change these Terms and Conditions at any time and any such change will be effective once published on the website and consequently will apply to all new orders.

Regrettably, for reasons of hygiene, we are unable to refund or exchange earrings. We ask that swimwear is returned with the protective film in place to receive a full refund or exchange.

Placing an order on whistles.com couldn’t be easier. Here’s a few steps to get you started.

Once you have chosen your item, add it to your shopping basket. Enter your login details. Include your address and choose your payment method then finally confirm your order.

Once we have received your order, we will send you a confirmation email to the address provided. This will contain your order number and details of your purchase(s). Please be aware that this email is only an acknowledgement that your order has been received, it is not an acceptance by us of any offers to purchase goods. An order despatch email will be sent and payment taken from your credit/ debit card when we have checked our stocks and can confirm we have the goods you ordered. This is the point when we have agreed to a contract with you.

Once you receive the order despatch email this will act as confirmation that your item(s) have been sent. You may receive multiple order despatch emails if your order is being shipped in more than one parcel. If any goods are unavailable, you will receive an email to confirm this and no payment will be taken for these goods. We reserve the right to refuse any order prior to despatch.

We are unable to amend or cancel any orders once they are placed. Instead, once your order has arrived, simply follow the returns instructions enclosed and where we have received your goods you will be issued with a refund.

It is really important to ensure you have given us the correct billing address. If it is incorrect we may not be able to process your order and you may incur additional costs to your credit/debit card.

RISK AND TITLE

Risk in the products will pass at the time the products are delivered. Ownership of products delivered will only pass when we receive payment in full of all sums due in respect of the products (including packing and delivery costs). If we do not receive payment in full we may, without prior notice, claim from you any products that have been delivered.

CHECK STOCK IN STORE

Our ‘Check Stock In Store’ service shows you product availability in your local Whistles store. Please note, this is only a guide to stock levels so, the best thing to do is call ahead before visiting the branch to make sure that the item is still available.

This service displays stock that is available in Whistles standalone stores only and does not apply to concessions or wholesale.

If you wish to reserve an item, our teams would be more than happy to hold garments for up to 48 hours.

If you wish to purchase the item over the phone we will deliver it to an address of your choosing. Please be aware that a postage cost will be applied to your order.

If you have purchased the item over the phone and you wish to return to a Whistles store, please ensure your goods are returned within 28 days from the date of receipt with the dispatch note as your receipt.

If you have purchased the item over the phone and you wish to return by post, simply complete the enclosed returns form including your name, Transaction ID and Till ID. Ensure your goods are securely wrapped and the completed returns form is enclosed along with a copy of your till receipt. Please note that we will not be able to process your return without this paper work. All you’ll need to do is attach the Freepost Returns Label to the parcel and take this to your local Post Office. Make sure you obtain a ‘proof of postage’ receipt which you should retain until you’ve received your refund. We aim to process and refund online orders within 14 working days of you returning the items. You will receive an email to confirm your return has been processed. Please note it may take 3-5 days for the refund to appear in your account.

We are unable to process exchanges for items returned via post however you can visit your local standalone store for this service.

RETURNING GOODS TO STORE

Please ensure your goods are returned to store within 28 days from the date of receipt, with a dispatch note as your receipt.

We offer this facility at any Whistles standalone stores. Unfortunately, this returns service is not available at Whistles concessions or factory outlets. When presenting your dispatch note you will be asked the reason for the return, and whether you wish to exchange the item or obtain a refund.

Products must be returned unused, in perfect condition and in the original packaging (for example with any applicable tags and stickers attached and protective/ other materials in place) or the return and refund could be refused.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are contracting with us as a consumer online or by phone, you have the right to cancel your contract at any time up to 14 working days after the day on which you received the goods you ordered. Notification of the cancellation must be received in writing within 14 working days, starting from the day after the goods are received. We will refund the cost of the item(s) ordered and, in addition to this, any paid delivery charge. Please note that the delivery charge refund will be to the value of standard delivery (as permitted by law).

RETURNING GOODS BY POST

It’s easy to return your item(s) by post. Simply complete the enclosed returns form with your name, address, and order number. Ensure your goods are securely wrapped and the completed returns form is enclosed, then attach the freepost returns label to the parcel.

Take the goods, along with the dispatch note, to the Post Office. Make sure you obtain a proof of postage certificate which you will need to retain until you have received your refund. Our Terms and Conditions outline the entire agreement between Whistles and our customers regarding the sale, purchase and use of goods. They supersede any previous agreement or understanding that may have previously been in place. No variation to these terms are binding unless agreed by us in writing.

Save to the extent that you exercise your right as a consumer to bring an action in or rely on the laws of your country of domicile, the interpretation, construction, effect and enforceability of these Terms and Conditions shall be governed by English Law, and you and we agree to submit to the non-exclusive jurisdiction of English courts for the determination of disputes.

When you pay for goods costing £100+ on credit, you have additional rights to make a claim against the credit provider. If you’ve complained to us and the complaint remains unresolved after 8 weeks or we send a “deadlock” letter, you may contact the Financial Ombudsman Service. 2. This competition is open to UK and international residents, aged 18 years or over. Employees of Whistles, its parent company TFG Brands London and the immediate family (spouse, parents, siblings, children) and household members of each such employee, are not eligible to participate in the competition.

3. This competition will commence at 10:00 GMT on 20th February 2025 and closes on 19:00 GMT 20th March 2025. All entries must be received by this closing date. Whistles accept no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach Whistles by the relevant closing date for any reason. At Whistles, we’re happy to offer fast, convenient and FREE UK Returns. The quickest way to receive a refund is by visiting one of our Whistles standalone stores.

We have 38 UK stores nationwide, and you can find your nearest Whistles by visiting the store finder.

If you're not completely satisfied with your order you can return it to us within 28 days of purchase using one of the below methods. The easiest and quickest way to return your order is to visit your nearest Whistles store.
If you did not receive a pre-printed returns label in your parcel, simply click this link to return via Royal Mail. You will need to enter your email address and your order number.
Store Returns: Item/s must be in their original, unworn state together with a valid receipt.
Please allow 14 working days for returns to be received by our distribution centre and processed from the date of posting. Please note it may take 3-5 days for the refund to appear in your account.
For a refund items must be unused, returned in the original packaging (where possible) and in a re-sellable condition. For reasons of hygiene we are unable to refund or exchange face masks or earrings for pierced ears. Removing any 'do not remove' labels will invalidate any returns.
Please note, Gift Cards are non-refundable.
Wedding dresses can be returned either by post/yodel to our warehouse or to our flagship store at St. Christopher's Place. Please ensure dresses are unused and in resalable condition.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are contracting with us as a consumer online or by phone, you have the right to cancel your contract at any time up to 14 working days after the day on which you received the goods you ordered. Notification of the cancellation must be received in writing within 14 working days, starting from the day after the goods are received. We will refund the cost of the item(s) ordered and, in addition to this, any paid delivery charge. Please note that the delivery charge refund will be to the value of standard delivery (as permitted by law).
We will process a refund back to your original payment method.

Returning to one of our Whistles stores is fast, convenient and free.

Online purchases can only be refunded at Whistles UK and international standalone stores. Unfortunately, this return service is not available at Whistles concessions, TFG Norwich or factory outlets.
Please ensure your goods are returned to the store within 28 days from the date of receipt, with a dispatch note as your receipt.
When presenting your dispatch note you will be asked the reason for the return, and whether you wish to exchange the item or obtain a refund.
Wedding Dresses can only be returned to our St Christopher's Place London store or returned to our Warehouse.
Refunds can only be issued onto the credit/debit card used for payment.

How long do I have to return?
If your purchase is not suitable, you have 28 days from receipt to return this back to our warehouse or into a standalone Whistles store (exclusions apply). This applies to full price and sale items.
Where is my refund?
Your return will take 14 working days to be delivered to our warehouse and to be processed. Please note it may take 3-5 days for the refund to appear in your account. You will be notified via email once your return is complete and refunded. Please allow the full 14 days after the delivery for our returns team to process your order and refund.
I sent back more than one item, but have only been refunded in part
Your parcels may not arrive back at our warehouse together, please allow up to 14 working days for parcels to be delivered to our warehouse and to be processed. Please note it may take 3-5 days for the refund to appear in your account. As parcels may be separated in transit please allow the full 14 working days for all refunds to be processed.
Can I exchange an item?
We do not offer exchanges through postal returns; your order will be refunded. A new order can be placed for the item or size you wish to change. Exchanges can be made in a standalone Whistles store.

UK FREE returns by post

Returning online purchases via post is FREE in the UK.

We’ve made it easy and free to return your item(s) by post.

Simply complete the enclosed returns form with your name, address, and order number. Ensure your goods are securely wrapped and the completed returns form is enclosed, then attach the freepost returns label to the parcel.
We strongly advise all customers to ensure they label their parcels with 'return to sender' address details in case of any further government restrictions for delivery carriers.
Take the goods, along with the dispatch note, to the Post Office. Make sure you obtain a proof of postage certificate which you will need to retain until you have received your refund.
We aim to process and refund online orders within 14 days of you returning the items. Please note it may take 3-5 days for the refund to appear in your account.

If you’re not able to visit one of our Whistles stores, we offer a free and easy collection service with the Royal Mail, which can be booked at a convenient time for you.

You’ll need the free returns label we’ve enclosed in your parcel, so keep this to hand to attain tracking information for arranging your collection.

Return of goods purchased over the phone

Returning phone purchases via post is FREE in the UK.

If you have purchased the item over the phone and wish to return by post, simply complete the enclosed returns form including your name, Transaction ID and Till ID. Ensure your goods are securely wrapped and the completed returns form is enclosed along with a copy of your till receipt.

Please note we are unable to process your return without this paperwork.

Attach the Freepost Returns label to the parcel and take this to your local Post Office. Make sure you obtain a proof of postage receipt, which you should retain until you have received your refund.

This Site is run by Whistles Limited (“Whistles”/ “we”/ us”/ “our”), which is registered with the Information Commissioner’s Office under registration number ZA111079. Whistles Limited is the “controller” of the personal information collected through the Site, by phone, email or other communication, with our Customer Services team, or in any Whistles store. How we share your information

We share your information with our core service providers and third party platforms as required for our business to function; for example, payment processing, picking, packaging and processing orders, fulfilling deliveries, customer support, fraud detection, credit risk reduction checks, IT systems support, and internal audits, for example:

If you have made an order, your contact details will be passed to delivery couriers.

If you choose to provide feedback on your transaction, we may share your information with third party feedback sites who will capture your feedback on transactions which we use to enhance our customer service.

Your information may be processed by a third party in order to test, enhance or maintain the functionality of our Site and database.

In the event that you add items to your basket but do not complete a transaction, we will use our partner Bloomreach B.V.’s technology to automatically send you an e-mail to remind you that there are items in your basket.

We operate a refer-a-friend programme to enable our customers to recommend us to their friends and family. Our refer-a-friend programme is operated on our behalf by Mention Me Limited as our data processor. You can object to us processing your data in connection with our refer-a-friend programme at any time by contacting us.

Whilst you are a member of our mailing list we may share your information with trusted non-core service providers, such as marketing partners we have carefully selected to deliver incentives to participate in offers, events, polls, surveys, analysis or research, all of which assist us in enhancing our services. They are not permitted to use your information after you unsubscribe.

We also use services offered by Google, Facebook, Instagram and other similar social media platforms to better tailor our marketing communications and for targeted advertising. As part of this process, some personal information, such as your e-mail address, is provided to the relevant third party, however for security purposes this data is “hashed” prior to being shared. Hashing is a process of identity masking or “pseudonymisation” which means we do not disclose your e-mail but still enables linking between your social media presence and our Site. Your personal information will be transmitted to countries outside of the EEA, including the United States. We receive insights from Facebook about the effectiveness of our advertising campaigns which you experience on our Site and social channels. This helps to better target our advertising.

Every external company we work with has a contract with us which clearly sets out our expectations and requirements in handling personal information and obligates them to meet these standards and those contained in the GDPR. We will only share the personal information that each company needs in order to perform the specific services we have instructed them to carry out.

If you make an international online order, Globale UK Limited will fulfil this and complete the delivery. Globale UK Limited will collect your data from you directly, and your data will then be processed by Globale UK Limited in accordance with their privacy policy, linked here.

International transfers

The delivery of products to you may require us to transfer your data outside of the European Economic Area. In such cases we will protect your personal data and ensure that the transfer complies with data protection law, usually by using clauses approved by the European Commission and the relevant UK authorities, i.e. standard contractual clauses.

How long we keep your information

We retain the information you provide for the following periods:

for as long as you are subscribed to receive marketing information and, afterwards, indefinitely in our suppression lists to ensure that you do not receive such information;

for as long as your account is being used and for a period of three years after the date you cease to use your account, after which period we will anonymise the personal information on file by deleting the personal information and allocating a personally unidentifiable unique reference ID and store the remaining information for a period of five years (“Data Retention Period”). After this time it will be permanently deleted from all systems and back-ups. If you wish to set up an account after this period this will be treated as a new account and your transaction history will not be available; and

in the case of any contact you may have with our Customer Services team, for as long as is necessary to provide support-related reports and trend analysis.

Our Data Retention Period has been determined to cover contractual and legal requirements, credit risk, fraud detection and customer service periods, as well as to cover regulatory requirements, and the resolution of disputes or fraud prevention.

How we store your information

Your information may be processed by our staff or by the staff of our suppliers to the extent necessary to fulfil your order. By submitting your personal information to us, you agree to the transfer of your personal information, its storage and processing.

We will keep the data which we collect from you on a secure server. Any information you give us relating to credit card details is handled by a PCI DSS compliant third party and encrypted using secure server technology. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access and require our suppliers to do the same.

Where we have given you a password (or where you have chosen one) to access certain parts of this Site, you are responsible for keeping this password confidential. We ask that you do not share a password with anyone.
